Description of procedure: Summarised minutes when negotiating pursuant to Section 11 of the Swedish Employment (Co-Determination in the Workplace) Act and Section 32 of the Swedish Employment Protection Act

Summarised minutes are used in the following negotiations pursuant to Section 11 of the Swedish Employment (Co-Determination in the Workplace) Act:

  • Changed organisational placement (which does not affect the organisation)
  • Change of title
  • Discontinuation of an appointment procedure/recruitment process (statement and vacancy announcement are to be attached).

Summarised minutes are also used when negotiating right of priority for re-employment pursuant to Section 32 of the Swedish Employment Protection Act:

  • When employing an employee other than the person who has right of priority for re-employment or a question arises as to which of several persons with right of priority shall be re-employed (statement and vacancy announcement are to be attached)
  • Negotiation prior to appointment as manager.

Procedure

  • Summarised minutes are only used when the parties are in agreement.
  • The summarised minutes and documentation are sent by email to the relevant employee organisation’s role-based email address.
  • The type of negotiation with the section of the law and matter are stated in the specification.
  • The line in the minutes with the name of the minute-checker is left blank when they are sent to the trade unions. They will enter the name of their minute-checker for each matter.
  • Remember to attach the negotiation documentation.
